Seller of Holistic Tea Warned by FDA
On February 17, 2022, the FDA issued a warning letter to Vital Health & Wellness following an inspection of the company’s website, which found statements made about the company’s product, Dr. Miller’s Holistic Premium Holy Tea, to be drug claims.
For example, Dr. Miller’s Holistic Premium Holy Tea was promoted with statements such as, “MAY BE BENEFICIAL FOR:…ACID REFLUX…HIGH BLOOD PRESSURE.” Other claims on the company’s “Ingredients” page promoted certain product ingredients such as Holy Thistle, Persimmon Leaves, Ginger, and more with drugs claims such as, “…Persimmon leaves have anti-hypertensive, anti-carcinogenic, and anti-mutagen properties…” and “Holy Thistle products are popular in Europe and the United States for various types of liver disease, being able to counteract the harmful actions of alcohol on the liver (cirrhosis)…Some clinical trials indicate that it may improve quality of life and even increase life expectancy in patients with cirrhosis of the liver,” among others.
The agency warned that Dr. Miller’s Holistic Premium Holy Tea is not generally recognized as safe and effective for use under the conditions prescribed, recommended, or suggested, making this product a “new drug.” The product was also deemed misbranded because Dr. Miller’s Holistic Premium Holy Tea fails to bear adequate directions for its intended use.
The FDA has advised Vital Health & Wellness Brand to notify the agency in writing within 15 days of receipt of the warning letter outlining specific steps taken to address any violations.
