Marketer of Weight-Loss System Settles FTC Charges of Deceptive Advertising

On March 1, 2005, the Federal Trade Commission (FTC) announced that California infomercial producer Modern Interactive Technology, Inc. (MIT), and its two principals, Mark Levine and David Richmond, agreed to settle Federal Trade Commission charges that they had an active role in developing the deceptive claims made to sell “The Enforma System” weight-loss products. The settlement requires, among other things, that the defendants have competent and reliable scientific evidence to substantiate future claims for any dietary supplement, food, drug, or device.
